Note that an application for a student visa has to be filed at the Home Office before your present permit expires if you are present in the UK.
The student visa application is based on a letter of enrolment in which the college or institution confirms that the student has been enrolled for a course entailing not less than 15 hours organized daytime study per week. That excludes correspondence courses or after hour courses.
Such a student visa allows the student to work for 20 hours per week during the term and for unrestricted hours during the holiday periods.
The student will also have to prove that he or she is able to maintain himself or herself whilst studying in the United Kingdom without recourse to public funds.
Provided that the student has attended the classes and has made satisfactory progress, he or she will usually be entitled to apply for an extension of the student visa when the first period of the visa expires.
Applications are usually successful and we normally get the clients passports back from Home Office within 6 -21 days after filing.
A person's status can be changed in the UK from that of a visitor or a two-year working holidaymaker to that of a student provided that he or she is not a visa national. A student visa application could also be made in the applicant's Home country (British High Commission) but then it would be necessary to attend an interview.
If a married person is enrolled for a study course, which is for a period of 12 months or more, he can, in his application for a student visa, include his/her spouse and children under the age of 18 years. His/Her spouse will be allowed to take up full time employment for the period of the studies of the applicant. The couple's children will not be allowed to attend state schools but will have to be enrolled in a fee-paying school (private school).
